Constitutional Conversations A1 S8 C3 Indian Tribes
A1 S8 C3 says in part “The Congress shall have Power… to regulate Commerce… with the Indian Tribes”
Up until the Constitution and somewhat after, Congress dealt with the Indians tribes as separate nations. Thomas Jefferson said in his First Annual Message to Congress(1):
“Among our Indian neighbors, also, a spirit of peace and friendship generally prevailing and I am happy to inform you that the continued efforts to introduce among them the implements and the practice of husbandry, and of the household arts, have not been without success; that they are becoming more and more sensible of the superiority of this dependence for clothing and subsistence over the precarious resources of hunting and fishing; and already we are able to announce, that instead of that constant diminution of their numbers, produced by their wars and their wants, some of them begin to experience an increase of population.”(1)
In 1830, many of the Indian tribes were forced to relocate West. This was known as the Trail of Tears which both Indians and Anglos regret. Cleon Skousen remarks, “It seemed a matter of providential justice that some of the barren regions where many of the Indians were relocated turned out to be among the richest oil fields in the country!”(2)
Congress granted all Indians US citizenship in 1924. Indians continue to have the option of living on the reservations as Indian tribes, under the jurisdiction of Congress with title to land which has been allotted them. Or he can fully assimilate in present American culture with all the rights and privileges of an American.
