The Congress shall have Power To… regulate Commerce… among the several States  ~ A1 S8 C2

One of the most serious inadequacies of the Articles of Confederation was that generally speaking, each state was more concerned about its prosperity than they were for the general welfare of all the states. This was one of the major motivations to call for a Constitutional Convention.  The states issued as the object for the Constitutional Convention: “to devise such measures as might appear necessary to render the Constitution of the Federal Government adequate to the exigencies of the Union.”(1)

The responsibility to regulate inter-state commerce was given to Congress. Each state was to regulate commerce within it own borders, known as intra-state commerce. Then Congress was to make the commerce between the states regular so that one state could not put another at a disadvantage.

Then through a series of Supreme Court opinions, the emphasis shifted from commerce to regulation. “Commerce” was defined as “every species of movement of persons or things”. In the late 1800’s this regulation by the federal government began to rule over and regulate railroads. In 1914, this “regulation” began to include all interstate transportation and communication. In 1935 the federal government began to regulate labor relations and began to control wages, hours and working conditions. This expanded into controlling prices. 

Ironically when the government controls prices, instead protecting citizens, it commonly forces citizens out of business. If farmers are allowed to charge more for an item when a drought has affected produce, the wealthy would still buy potatoes at twice the cost, the poor might have to eat rice instead that year. But then the farmer can cover his costs and plant more next year. When the government forces price controls, farmers cannot recover their losses so easily and sometimes are forced out of business. 

Father, we thank You for law and order, but we look to You for wisdom for our self-government and duties. Anoint us to glorify YOU! In Jesus’ Name, Amen.
