Constitutional Conversations: A1 S8 C10 Law of Nations

The Congress shall have Power To define and punish Piracies and Felonies committed on the high Seas, and Offenses against the Law of Nations” ~ A1 S8 C10

In the Constitutional debates, Madison said, “If the laws of the states were to prevail on this subject, the citizens of different state would be subject to different punishments for the same offense at sea. There would be neither uniformity nor stability in the law…”(1)

“Governor Morris pointed out that such laws must be defined before they can be punished. He said they should be ‘definable, as well as punishable, … the law of nations, being often too vague and deficient to be a rule.’”(2)

Thomas Jefferson stated in his address to the Congress in 1801:

“To this state of general peace with which we have been blessed, one only exception exists. Tripoli, the least considerable of the Barbary States, had come forward with demands unfounded either in right or in compact, and had permitted itself to denounce war, on our failure to comply before a given day… The bey had already declared war in form. His cruisers were out… The bravery exhibited by our citizens on that element, will, I trust, be a testimony to the world that it is not the want of that virtue which makes us seek their peace, but a conscientious desire to direct the energies of our nation to the multiplication of the human race, and not to its destruction.”(3)

At the close of the war of 1812, the United States sent Commodore Decatur with a fleet of nine ships to punish the Barbary pirates. He captured their principal ships, entered the Bay of Algiers and dictated a treaty to the humbled ruler. He then sailed to Tunis and Tripoli, where the pirates pledged good conduct from then on. Since that time, the piracy clause of the Constitution has remained practically obsolete.”(4)
