Tariffs and the Constitution

With the recent Supreme Court ruling, President Trump cannot directly charge tariffs on other countries. As the Executive, he should be able to enact the policy that Congress is establishing. This is solvable through returning to the original intent of the Constitution, through Congress.

There were four very un-Constitutional polices that were set under Woodrow Wilson in 1913:

  • The 16th amendment
  • The 17th Amendment
  • The Tariff Act
  • The Federal Reserve Act

They all need to be repealed/overthrown.

I propose some goal setting. I would begin with repealing these two:

  • The 16th amendment
  • The Tariff Act

Step 1: Return to the original intent of charging other countries tariffs to pay for our federal government expenses and shrink the government to a size that can be covered by those tariffs.

President Trump is famously and fabulously returning to the original intent of our founding by establishing taxes on other countries through tariffs. I would love to hear this as posed from an original intent of the Constitution perspective instead of it just being seen as Trump’s policy. I realize it is his policy. I don’t know if he knows that it’s a Constitutional principle. I’ve never heard him share it as such. I think it would go very far toward helping him win support where he doesn’t have it presently. And wouldn’t it be great if Congress enacted a law to restore tariffs on other countries, since they do “hold the purse”?

Step 2: Repeal the 16th amendment and return to indirect taxes through the states instead of direct taxes on individuals. I think part of this process has got to be to teach the public what “just” taxes are and what aren’t, what “General Welfare” actually means, and encourage people to let go of all specific taxes. This will require revival, conscience, conviction and dying to self. It can only happen, I believe, through revival and reformation, and I’m not sure it can work without our churches.

People need to understand how King George III would give money to his “pets” (people who did his bidding) and that’s what the Founding Fathers were trying to avoid in establishing General Welfare, which is why they wanted every law to have to pass through the Senate which directly represented our states (before the 17th amendment) and the House- which represented the people. We must return to General Welfare

President Trump should not make promises to a certain group of Americans. I know it’s in his generous nature to do so. But it sure would be nice if it was not with our tax money. Someone needs to talk to him about this.

The founders did not want taxes charged directly on our heads but indirectly by taxing the states and then giving that money up to the Fed as needed, not on individuals before we even get our paycheck, having access to our personal information, going straight to the Fed and then back to the states with mandates attached.

The deeper problem that we must solve is that we are Biblically illiterate as a culture. And those that are Biblically literate need to have the Virtue of the colonists and the framers. Learning how to reason from Scripture and how to apply it’s Biblical principles are integral to Liberty.

Where the Spirit of the Lord is, there is Liberty!

A3S1 Good Behavior

The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour ~ A3S1

In Federalist 79, Hamilton explained, “The precautions for their responsibility are comprised in the article respecting impeachments. They are liable to be impeached for mal-conduct by the House of Representatives and tried by the Senate; and, if convicted, may be dismissed from office and disqualified for holding any other. This is the only provision on the point which is consistent with the necessary independence of the judicial character…”(1)

In Federalist 78, he said, “The standard of good behavior for the continuance in office of the judicial magistracy is certainly one of the most valuable of the modern improvements in the practice of government. In a republic it is [an]… excellent barrier to the encroachments and oppressions of the representative body. And it is the best expedient which can be devised in any government to secure a steady, upright, and impartial administration of the laws…(2)

David Barton explains in Restraining Judicial Activism, “There is much additional evidence to prove that impeachment was not to be limited to the current narrow scope of criminal acts. For example, George Mason, the “Father of the Bill of Rights,” explained that impeachment was for “attempts to subvert the Constitution,” and Alexander Hamilton declared that impeachment was to be used for “the abuse or violation of some public trust… [or for] injuries done immediately to the society itself.” Constitutional Convention delegate Elbridge Gerry considered “mal-administration” as grounds for impeachment, and William Rawle included “the inordinate extension of power, the influence of party and of prejudice” as well as attempts to “infringe the rights of the people.” Justice Story… listed “unconstitutional opinions” and “attempts to subvert the fundamental laws and introduce arbitrary power.” Very simply, impeachment was the recourse when judges attempted to disregard public interests, to affront the will of the people, or to introduce arbitrary power by seizing the role of policy-maker.”(3)
